Heir of the artist’s widow, the Fondation Alberto et Annette Giacometti is the majority right-holder of the auhtor’s rights on Alberto Giacometti’s work. It grants permission to use these works for its share of the right (5/8ths).
For visual arts, a complementary permission has to be granted by the ADAGP or its sister society abroad for the minority part (3/8ths). For the texts and image of the artist, the Fondation operates as secretary for the Giacometti Committee, which represents all right-holders of the artist and grants permissions.
> Prior and formal permission of the Alberto and Annette Giacometti Fondation is mandatory
> Each use of a work has to be assorted with mandatory credit lines which are given along with the permission and must appear either next to the reproduction, or in a detailed table of illustrations.
> Isolated troncated portions of works are not allowed. Works have to be reproduced as a whole, including the pedestal which are part of the work. Reproducing a detail is possible, provided that it be clearly specified in the caption that it is a detail and that the work be reproduced as a whole in another part of the publication.
> No overprint is permitted on a work’s image.
> Use of a work’s image in connection to weight-reduction, anorexia and mental trouble is in principle not allowed.
In accordance with applicable national laws and international agreements, any unauthorized reproduction or any reproduction that exceeds the limit of the permission is an infringement of the author’s rights and, as such, exposes its author to law suits.
